Terms of Service

These Terms of Service govern your use of the Century Eye Care Medical Center (doing business as Century Eye Care) website and your participation in our text-messaging program. By using this site or opting in to messages, you agree to these terms.
1. Acceptance of these terms
If you do not agree with these terms, please do not use the website. We may modify these terms at any time; continued use after changes are posted means you accept the revised terms.
These terms include a binding arbitration clause and a class action waiver in Section 13, which affect how disputes are resolved. Claims of professional negligence or medical malpractice are expressly excluded from that section.
2. Not medical advice
The content on this website is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read here.
Do not use this website or text messaging for medical emergencies. If you are experiencing a medical emergency, including sudden vision loss, eye trauma, or severe eye pain, call 911 or go to the nearest emergency department immediately.
3. No provider–patient relationship
Using this website, submitting a form, or exchanging text messages does not by itself create a provider–patient relationship. That relationship begins only when you are seen and accepted as a patient of the practice.
4. Appointment and contact requests
Requests submitted through the website are not confirmed appointments. A member of our team will contact you to schedule or confirm. Please do not include detailed medical information in website forms, which are not a secure channel for protected health information.
5. Text messaging program terms
Program. Century Eye Care Medical Center sends text messages for two purposes only: confirming appointments and rescheduling appointments. We do not send marketing, promotional, or advertising messages.
Consent. You will only receive messages if you have given express consent, either on a signed patient form containing a text-messaging consent section or verbally to a member of our staff, which is recorded in your chart. Consent is not a condition of purchase or of receiving treatment, and may be withdrawn at any time.
Message frequency. Message frequency varies.
Cost. Message and data rates may apply. These are charged by your mobile carrier, not by us.
Opting out. Reply STOP to any message to stop receiving texts. You will receive one confirmation message, after which no further messages will be sent unless you opt back in.
Getting help. Reply HELP for assistance, or call the office at (310) 767-7814.
Carriers. Carriers are not liable for delayed or undelivered messages.
Supported carriers. Message delivery depends on your carrier's network and may not be available on all carriers.
Privacy. Mobile information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
6. Acceptable use
You agree not to use the website to violate any law, infringe anyone's rights, transmit malicious code, attempt to gain unauthorized access to our systems, scrape or harvest data, or interfere with the site's operation or security.
7. Intellectual property
The website and its content — text, graphics, logos, images, and layout — are owned by Century Eye Care Medical Center or its licensors and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. Any other use requires our prior written permission.
8. Third-party links and content
The website may link to third-party sites and services we do not control. We are not responsible for their content, products, or practices, and a link does not imply endorsement.
9. Disclaimer of warranties
The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current.
10. Limitation of liability
To the fullest extent permitted by law, Century Eye Care Medical Center, its owners, providers, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or the messaging program. Nothing in these terms limits liability that cannot be limited under applicable law, including liability relating to professional medical services.
11. Indemnification
You agree to indemnify and hold harmless Century Eye Care Medical Center and its personnel from claims and expenses arising out of your misuse of the website or your violation of these terms.
12. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
13. Binding arbitration and class action waiver
Please read this section carefully. It affects how disputes are resolved, and it limits your right to go to court or to participate in a class action.
Scope. Any dispute arising out of or relating to this website, these terms, or our text-messaging program will be resolved by binding individual arbitration rather than in court.
What is excluded. This section does not apply to claims of professional negligence or medical malpractice, or to any other claim arising out of the provision of medical care. Those claims are governed by the separate agreements you sign as a patient and by California law, including California Code of Civil Procedure section 1295. This section also does not prevent either party from bringing an individual claim in small claims court.
Process. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Los Angeles County, California. The arbitrator’s award may be entered as a judgment in any court of competent jurisdiction.
Individual basis only. Claims must be brought in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding.
Your right to opt out. You may opt out of this arbitration section within 30 days of first accepting these terms by emailing info@centuryeyecare.com with your name and a statement that you decline arbitration. Opting out will not affect any other part of these terms, and will not affect your care in any way.
Court proceedings. Where a claim is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Los Angeles County, California.
14. Changes to these terms
We may revise these terms at any time. The effective date above reflects the most recent revision.
